Cancellation of Power of Attorney Format (Revocation Deed)

You can withdraw a power of attorney you gave, as long as the agent has no protected interest in the subject matter. Revocation works best when it is in writing, executed with the same formality as the original, and communicated to everyone who relied on the old power.

The legal basis in plain words

  • The principal may revoke the agent’s authority at any time before it has been exercised so as to bind the principal (section 203, Indian Contract Act).
  • If the agent has an interest in the property that forms the subject of the agency, the agency cannot be terminated to the prejudice of that interest without an express contract (section 202).
  • A person who acts in good faith under a power, without knowing it was revoked, is protected (section 3, Powers of Attorney Act). This is why notice matters.

Frequently asked questions

Can I revoke a power of attorney without the agent’s consent?

Generally yes, under section 203 of the Contract Act, unless section 202 applies because the agent has an interest in the subject matter.

Does a revocation need stamp paper?

Most States charge stamp duty on revocation deeds. Check your State’s schedule; the format leaves the value blank.

Is an irrevocable power really irrevocable?

Only where the law protects it, mainly under section 202. Labelling a deed irrevocable does not by itself make it so.

Do I need to register the revocation?

If the original was registered, registering the revocation is the safe course so the records show it. If it was only notarised, a notarised revocation with notice is usual.
