Drafting note: A lease for a term exceeding one year must be registered under the Registration Act, 1908. Some States, such as Maharashtra, require leave and licence and rent agreements to be registered whatever the term. Check your State’s rule and stamp duty.
Why rent agreements are usually for 11 months
A lease of immovable property from year to year, for any term exceeding one year, or reserving a yearly rent must be registered: section 17 of the Registration Act, 1908 lists it among compulsorily registrable documents, and section 107 of the Transfer of Property Act, 1882 says such a lease can be made only by a registered instrument. A lease for one year or less is optional to register under section 18. An 11-month term keeps a margin below that line, which is why it became the common practice. It is a practice, not a legal requirement, and some States require registration whatever the term: Maharashtra’s section 55 is the best known example.

Frequently asked questions
Is a notarised rent agreement valid?
A notarised rent agreement for 11 months is widely used where registration is optional for short leases. Notarisation records the signing; it does not replace registration where registration is compulsory.
Who pays the stamp duty on a rent agreement?
Whoever the parties agree. Many agreements put it on the tenant; the amount is set by State law.
Can the rent agreement be on plain paper?
An agreement chargeable with stamp duty that is not stamped cannot be admitted in evidence until the duty and penalty are paid (section 35, Indian Stamp Act). Use stamp paper or e-stamp.
What is the maximum security deposit?
Unless your State has adopted a law such as the Model Tenancy Act, which caps deposits at two months’ rent for residential premises, there is no general cap; it is agreed between the parties.
Do I need police verification of tenants?
Many city police departments require it. Check your local police website.
